INSURANCE ON FILE WORK MAY PROCEED UNTIL INSURANCE EXPIRES -�/- I - Olo CLERK OF COUNCIL DATE: OCT 1 7 2005 FIRST AMENDMENT TO CONSULTANT AGREEMENT A- 2005 -170 THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into on July 18, 2005, by and between ANTECH Diagnostics, a California corporation ( "Consultant ") and the City of Santa Ana, a charter city and municipal corporation of the State of California ( "City "). Recitals: A. The parties entered into Consultant Agreement N2005 -055, dated December 15, 2004, (hereinafter "said Agreement ") by which Consultant has provided veterinary diagnostic laboratory services for the Santa Ana Zoo. B. In accordance with the terms and conditions of said Agreement, the parties wish to renew said Agreement for an additional one -year period and to increase available compensation to pay for services during the extended term. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Consultant Agreement, the parties agree as follows: 1. Section 2.a, COMPENSATION, shall be deleted in its entirety and replaced with the following: "a. City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Consultant's Fee Schedule, dated February 1, 2005, attached hereto as Exhibit A -1. List prices include pick up of samples and delivery of specimen collection/submission materials. The total sum to be expended under this Agreement shall not exceed $13,000.00, during the 2005- 2006 fiscal year." 2. Section 3, TERM, shall be amended to extend the termination date from June 30, 2005 through June 30, 2006. 3. Except as herein amended, all terms and conditions of said Agreement shall remain in full force and effect."
