INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />-�/- I - Olo <br />CLERK OF COUNCIL <br />DATE: OCT 1 7 2005 <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br />A- 2005 -170 <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />on July 18, 2005, by and between ANTECH Diagnostics, a California corporation <br />( "Consultant ") and the City of Santa Ana, a charter city and municipal corporation of the <br />State of California ( "City "). <br />Recitals: <br />A. The parties entered into Consultant Agreement N2005 -055, dated December 15, <br />2004, (hereinafter "said Agreement ") by which Consultant has provided veterinary <br />diagnostic laboratory services for the Santa Ana Zoo. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />renew said Agreement for an additional one -year period and to increase available <br />compensation to pay for services during the extended term. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 2.a, COMPENSATION, shall be deleted in its entirety and replaced with the <br />following: <br />"a. City agrees to pay, and Consultant agrees to accept as total payment for its <br />services, the rates and charges identified in Consultant's Fee Schedule, dated <br />February 1, 2005, attached hereto as Exhibit A -1. List prices include pick up of <br />samples and delivery of specimen collection/submission materials. The total sum to <br />be expended under this Agreement shall not exceed $13,000.00, during the 2005- <br />2006 fiscal year." <br />2. Section 3, TERM, shall be amended to extend the termination date from June 30, <br />2005 through June 30, 2006. <br />3. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect." <br />
