<br />The term of this Agreement shall begin upon execution of this Agreement and shall extend to <br />June 30, 2018. <br /> <br />3. DEFINITIONS: <br /> <br />As used in this Agreement, the following words and phrases shall have the meaning assigned in <br />this section, unless the context at the point of usage clearly requires a different meaning. <br /> <br />(1). Agreement shall mean this Amended and Restated Agreement, including the exhibits <br />thereto and the documents incorporated herein by reference. <br /> <br />(2). Auditor shall mean the certified public accountant firm retained by City for auditing <br />servIces. <br /> <br />(3). Bin Service shall mean all Solid Waste collection services provided by CONTRACTOR by <br />means of front-loaded collection bins of various sizes. <br /> <br />(4). California Integrated Waste Management Act ("CIWMA") shall mean that act codified by <br />California Public Resources Code Sections 40000 et seq., and any subsequent amendments thereto. <br /> <br />(5). California Integrated Waste Management Board shall mean the Board created by the <br />California Integrated Waste Management Act, and any subsequent modifications thereto, and shall <br />encompass any other agency which assumes the duties of this Board. <br /> <br />(6). CITY shall mean the City of Santa Ana. <br /> <br />(7). City Attorney shall mean the City Attorney of CITY. <br /> <br />(8). City Council shall mean the City Council of CITY. <br /> <br />(9). City Manager shall mean the City Manager of CITY. <br /> <br />(10). Clerk of the Council shall mean the Clerk of the Council of CITY. <br /> <br />(11). Code shall mean the Municipal Code of CITY, both codified and miscellaneous <br />ordinances. <br /> <br />(12). Commercia1lIndustrial Bin Service shall mean Bin Service which IS provided by <br />CONTRACTOR to commercial and/or industrial units. <br /> <br />(13). Commercial Solid Wastes shall mean Solid Waste originating from stores, business <br />offices, commercial warehouses, hospitals, educational, health care, military and correctional <br />institutions, non-profit research organizations and government offices. <br /> <br />(14). Compost means the product resulting from the controlled biological decomposition of <br /> <br />3 <br /> <br />25A-11 <br />
