<br />Curbside Service Units. CONTRACTOR shall make records containing Roff-Off Service available to <br />the Executive Director at any reasonable time. <br /> <br />26. COMPENSATION FOR GRANTS: <br /> <br />CONTRACTOR shall be permitted to obtain compensation in an amount approved by the <br />Executive Director for the management of grants pursuant to Section 18(g) herein. <br /> <br />27. ADJUSTMENTS TO CHARGES: <br /> <br />(a) HAULING AND PROCESSING CHARGES: <br /> <br />(1) PRICE INDICES: The two indices which will be used for determining adjustments <br />to Hauling and Processing Charges shall be the December Consumer Price fudex ("CPI") for All Urban <br />Consumers (base years 1982-1984 = 100) for Los Angeles-Anaheim-Riverside CMSA, published by <br />the United States Department of Labor, Bureau of Labor Statistics and the December Producer Price <br />fudex ("PPI"), Diesel Fuel #2 (#057303. When both indices are to be used to determine an adjustment <br />to the Hauling and Processing Charges, then the adjustment formula shall be as follows: the CPI shall <br />be weighted at ninety (90%) percent and the PPI shall be weighted at ten (10%) percent. <br /> <br />(2) CURBSIDE SERVICE: The Hauling Charges and Processing Charges for <br />curbside service shall be adjusted annually, using the CPI and PPI adjustment formula set forth in <br />subsection (a)(l) above without limitation; provided, however, that adjustments permitted to the <br />Hauling and Processing Charges during this time period shall be calculated at seventy five (75%) <br />percent of the CPI with a five (5%) percent maximum adjustment and a zero 0% percent minimum <br />adjustment per year. <br /> <br />(3) BIN SERVICE AND ROLL-OFF SERVICE: From July 1, 1997 until the <br />termination of this Agreement, the Hauling and Processing Charges for Bin Service and Roll-Off <br />Service shall be adjusted in accordance with the CPI and PPI adjustment formula set forth in subsection <br />(a)(I) above. Adjustments to the Hauling and Processing Charges for Bin Service and Roll-Off Service <br />shall be calculated at seventy five (75%) percent of the CPI with a five (5%) percent maximum <br />adjustment and a zero 0% percent minimum adjustment per year. <br /> <br />(b) GATE FEES: Should any increase or decrease in the Gate Fees charged by a Disposal Site <br />occur during the term ofthis Agreement, CONTRACTOR shall be permitted to pass through to both its <br />Bin Service Customers and its Roll-Off Service Customers and CITY shall pass through to its curbside <br />service users one hundred (100%) percent of such increase or decrease in the Gate Fees for that portion <br />of the Solid Waste which is taken to the Disposal Site. CITY shall pass through to CONTRACTOR <br />such increase or decrease in its curbside service payments to CONTRACTOR. Should a change in <br />Gate Fees become effective on July 1st of any year, the parties agree to utilize the tonnages from the <br />previous calendar year to determine the percentage of Solid Waste that is taken to the Disposal Site. <br /> <br />(c) SOLID WASTE PROGRAM SURCHARGE: Should any increase or decrease in the <br />Hauling and Processing Charge or the Gate Fees occur during the term of this Agreement, <br /> <br />21 <br /> <br />25A-29 <br />
