<br />2. The fee proposal shall reflect all anticipated fee increases for the contract <br />duration. The City of Santa Ana reserves the right to negotiate. the-final <br />fee prior to award of the contract. <br /> <br />3. A fee schedule for the proposed servIces must be provided in the fee <br />proposal. <br /> <br />4. Consultant compensation shall be on a noHo-exceed fee basis. The fee <br />shall reflect the scope of work and project requirements as outlined in this <br />Request for Proposals. All incidental costs to this contract shall be <br />included in the fixed fees provided. Failure to include the total scope of <br />work in the fee proposal shall disqualify the Consultant. <br /> <br />5. Hourly wage rates charged by principals and employees for extra work <br />shall be included. Extra work, if any, determined at a later date shall be . <br />clearly beyond the scope of the Request for Proposals and Agreement. <br /> <br />H. Commitment <br /> <br />I. The proposal must be signed by the individual, or company official with <br />the power to bind the company in its proposal. <br /> <br />2. The contents of the proposal of the successful Consultant shall become a <br />contractual obligation if a contract ensues. Failure of a Consultant to <br />accept this obligation will result in the cancellation of any award. Any <br />damage accming to the City as a result of a failure to contract may be <br />recovered from the Consultant. <br /> <br />3. The signer of the proposals must declare in writing that the only person, <br />persons, company or parties interested in the proposal as principals, are <br />named therein; that the proposal is made without collusion with any other <br />person, persons, company, or parties submitting a proposal; that it is in all <br />respects fair and in good faith without collusion or fraud, and that the <br />signer of the proposal has full authority to bind the principal proposer. <br /> <br />1. Prime Consultant Responsibilities <br /> <br />The selected Consultant will be required to assume responsibility for all services <br />offered in his proposal. The selected Consultant will be sole point of contact with <br />regard to contractual matters, including payment of any and all charges resulting <br />from the contract. <br /> <br />The selected Consultant will be expected to comply with all applicable federal, <br />state and local regulations, building codes, and contract provisions. <br /> <br />7 <br />
