These approvals allow <br />a gas station and convenience store and permit after hour operation. <br /> <br />Chevron would like to be able to complete this project to rebuild this service station to a more <br />modem facility. However during the process of preparing plans and obtaining permits to <br />rebuild this site, Chevron was caught up in a lawsuit that prevents them from making a capital <br />investment in this project until the suit is resolved. This lawsuit is unrelated to the CUP or <br />any other approval from the City of Santa Ana. At trial Chevron has received a summary <br />judgement in their favor, but the case was appealed and we are awaiting that outcome. <br /> <br />We had completed all ofthe necessary drawings for this reconstruction project and the <br />Building Department had approved plans on 10/16/03. No building permit was issued due to <br />the unfortunate delay of the lawsuit. We anticipate that once the legal obstacles are removed, <br />we will need to re-process the construction documents for building permits due to the time that <br />has passed. <br /> <br />At this time, we would like to request that the existing CUP approvals be extended for one <br />year, until January 2007. This additional time will allow the legal proceedings to be <br />completed and for us to re-process the construction documents for building permits.
