<br />A-2005-308 <br /> <br />STATE OF CALIFORNIA' DEPARTMENT OF TRANSPORTATION <br />RIGHT OF WAY CONTRACT - STATE HIGHWAY <br />RW 8-3 (Rev. 6/95) <br /> <br />Page 1 of 4 <br /> <br />Santa Ana <br /> <br />) California <br /> <br />12 <br />Dist <br /> <br />ORA <br />Co <br /> <br />5 <br />Rte <br /> <br />48.9 <br />KP <br /> <br />003409 <br />Exp Auth <br /> <br />,2005 <br /> <br />Grantor: The City of Santa Ana, a Municipal <br />Corporation, of the State of California <br /> <br />Document No. 102340-1. in the form of an Easement, Document No. 102340-2. this contract for a Temporary <br />Construction Easement covering the property particularly described in the above instruments have been executed and <br />delivered to Diana Staudinger, Right of Way Agent for the State of California. <br /> <br />In consideration of which, and the other considerations hereinafter set forth, it is mutually agreed as follows: <br /> <br />1. (A) The parties have herein set forth the whole of their agreement. The performance of this agreement <br />constitutes the entire consideration for said document and shall relieve the State of all further obligation <br />or claims on this account, or on account of the location, grade or construction of the proposed public <br />improvement. <br /> <br />(B) Grantee requires said property described in Document No.'s 102340 for ingresslegress and a temporary <br />construction area to construct and maintain an overhead guide sign on adjacent Caltrans property, a <br />public use for which Grantee has the authority to exercise the power of eminent domain. Grantor(s) is <br />compelled to sell, and Grantee is compelled to acquire a permanent ingresslegress easement and <br />temporary construction easement over said property. <br /> <br />Both Grantor(s) and Grantee recognize the expense, time, effort, and risk to both parties in determining <br />the compensation for the property by eminent domain litigation. The compensation set forth herein for <br />the property is in compromise and settlement, in lieu of such litigation. <br /> <br />C' <br />2. The State shall: $ -ft- ..d41/ , iU -. <br />k~l'~() ~. . <br />(A) Pay the undersigned grantor(s) the sum of $ 61.8"6.00 subject to all matter of re d for the permanent <br />ingresslegress easement and temporary construction easement conveyed by the a e documents on the <br />above reference property. <br /> <br />(B) Pay all escrow and recording fees incurred in this transaction and, if title insurance is desired by the <br />State, the premium charged therefore. <br /> <br />(C) At no expense to Grantor(s) and at the time of highway construction, perform the following <br /> <br />State's contractor will secure the area during construction. No access routes will he blocked during the <br />business hours of the Santa Ana Zoo. 8:00 AM to 5:00 PM. <br />
