The parties entered into Agreement#N-2004-128, dated October 7, 2004, (hereinafter <br />"said Agreement") by which Consultant has provided written examinations for Fire <br />Department personnel positions. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />increase compensation to provide for additional services and extend the term of said <br />Agreement for an additional one-year period. <br /> <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Second Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />L Section I, SCOPE OF SERVICES, shall be amended by adding a new paragraph 1.f. <br />which shall read, in full, as follows: <br /> <br />"I.r. City may request, in a writing executed by the Executive Director of Personnel <br />Services, that Consultant develop additional exams. Upon receipt of such request, <br />Consultant shall commence said additional services." <br /> <br />2. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the <br />following: <br /> <br />"a. City agrees to pay, and Consultant agrees to accept as payment for the <br />services, the rates and charges specified in Exhibit A. The total sum to be <br />expended under this Agreement shall not exceed $5,000.00, annually, during the <br />term of this Agreement." <br /> <br />3.
