ij,jCJI~I\: .... . ... -/.11 ,,-,, /., -- (; a t ~ { , :;.i I,j' , :); j; j f<L ~ ..__...__..._.......__._..__.__m ,_, i;\'i',i FOURTH AMENDMENT TO CONSULTANT AGREEMENT ',.11.. \li!]~ i THIS FOURTH AMENDMENT TO CONSULTANT AGREEMENT is entered November 08, 2005, by and between DMJM I Harris, dba Holmes & Narver, Inc., a California Corporation ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). RECITALS: A. The parties entered into Agreement #A-2001-1 70A, dated August 20,2001, (hereinafter "said Agreement") by which Consultant has prepared construction documents for Public Works and Parks projects, on an as-needed basis. B. The parties amended said Agreement to include within the Scope of Services, stormwater runoff management in compliance with NPDES standards and employee training regarding NPDES requirements. C. Said Agreement provided for a termination date of August 3 1,2005, however, the parties continue to provide services pursuant to said Agreement. Therefore, the parties now desire that said Agreement provide for a continuous term to provide services while allocated funds are available. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, as amended, except those amended in this Fourth Amendment to Consultant Agreement, the parties agree as follows: I. Section 3, TERM, shall be deleted in its entirety and replaced with the following: "This Agreement shall commence on August 20, 2001 and continue until funds allocated to this Agreement have been fully expended, unless earlier terminated in accordance with Section 12, below." 2. Except as hereinabove amended, all ternlS and conditions of said Agreement shall remain in full force and effect. II 1/ /1
