<br />ij,jCJI~I\: <br />.... . ... <br /> <br />-/.11 ,,-,, <br />/., -- (; a t ~ { , :;.i I,j' , <br /> <br />:); j; j f<L ~ <br /> <br />..__...__..._.......__._..__.__m <br />,_, i;\'i',i <br /> <br />FOURTH AMENDMENT TO <br />CONSULTANT AGREEMENT <br /> <br />',.11.. <br /> <br />\li!]~ <br /> <br />i <br /> <br />THIS FOURTH AMENDMENT TO CONSULTANT AGREEMENT is entered <br />November 08, 2005, by and between DMJM I Harris, dba Holmes & Narver, Inc., a <br />California Corporation ("Consultant") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br /> <br />RECITALS: <br /> <br />A. The parties entered into Agreement #A-2001-1 70A, dated August 20,2001, <br />(hereinafter "said Agreement") by which Consultant has prepared construction <br />documents for Public Works and Parks projects, on an as-needed basis. <br /> <br />B. The parties amended said Agreement to include within the Scope of Services, <br />stormwater runoff management in compliance with NPDES standards and employee <br />training regarding NPDES requirements. <br /> <br />C. Said Agreement provided for a termination date of August 3 1,2005, however, the <br />parties continue to provide services pursuant to said Agreement. Therefore, the <br />parties now desire that said Agreement provide for a continuous term to provide <br />services while allocated funds are available. <br /> <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, as amended, except those <br />amended in this Fourth Amendment to Consultant Agreement, the parties agree as <br />follows: <br /> <br />I. Section 3, TERM, shall be deleted in its entirety and replaced with the following: <br /> <br />"This Agreement shall commence on August 20, 2001 and continue until funds <br />allocated to this Agreement have been fully expended, unless earlier terminated in <br />accordance with Section 12, below." <br /> <br />2. Except as hereinabove amended, all ternlS and conditions of said Agreement shall <br />remain in full force and effect. <br /> <br />II <br /> <br />1/ <br /> <br />/1 <br />
