<br />. <br /> <br />. <br /> <br />. <br /> <br />A~2002-017 <br /> <br />" <br /> <br />\, <br /> <br />'" '5.-7-~ -/) i <br />L{ - J- 3-0 Z-- <br /> <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br /> <br />~ '. f'Q(S <br />~1N-. <br /> <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT, is entered <br />into on It?~ I L 2.. 3 , 2002, by and between Daly Project Services, Inc. dba <br />Daly International, a California corporation ("Consultant") and the City of Santa Ana, a <br />charter city and municipal corporation of the State of California ("City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into a Consultant Agreement dated May 18, 2001, hereinafter <br />referred to as "said Agreement", by which Consultant provides assistance to the City <br />in negotiating leases between the City and wireless communication providers to <br />install and maintain monopoles on City property. <br /> <br />B. Due to an increased need for Consultant's services, the parties wish to increase the <br />compensation available to Consultant during the term of said Agreement. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of the Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />I. Paragraph 2 a. of said Agreement shall be amended to read as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The total sum to be expended under this <br />Agreement shall not exceed $20,000.00 during the term of this Agreement. <br /> <br />2. Except as hereinabove amended the terms and conditions ofthe Agreement shall <br />remain in full force and effect. <br />
