.- " . \ , ~AMENDMENTTOAGREEMENT~ A-2001-234 THIS AMENDMENT, made and entered into this 4th day of August, 2001, by and between Pacific Coast Bottling., ("Consultant") and the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution and laws of the State of California ("City"), collectively referred to herein as "the Parties". RECIIALS A. The Parties entered into that certain agreement entitled "CONSULTANT AGREEMENT" dated May 22,2001, hereinafter referred to as "said Agreement", for bottled water services; B. The Parties hereto now desire to amend the "Compensation," "Notice," and "Exhibit A" terms of said Agreement in order to provide continuous uninterrupted services to the City under the Agreement. WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do hereby agree as follows: 1. Section 2, the "Compensation" term of said Agreement is hereby amended to reflect an increase in cost from $10,000.00 to $20.000.00 due to an unexpected need of Consultant services under said Agreement. 2. Section 3, the "Notice" term of said Agreement is hereby amended to change the Consultants contact person from Dennis Salmans to Mark Millsap. 3. Exhibit A the "When" section of said Exhibit is hereby amended to extend services provided by the agreement to June 30, 2002 to reflect the correct intent of parties agreement. 4. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged and in full force and effect.
