<br />. ' <br /> <br />mailing address shall not invalidate service by mail to the most current address <br />provided by that party. Personal service of notice is effective upon delivery. <br /> <br />3. Employment Status <br /> <br />CONSULTANT shall, during the entire term of the AGREEMENT, be construed to <br />be an independent Contractor and not an employee of the CITY. This <br />AGREEMENT is not intended nor shall it be construed to create an <br />employer-employee relationship, a joint venture relationship, or to allow the CITY to <br />exercise discretion or control over the professional manner in which CONSULTANT <br />performs the services which are the subject matter of the AGREEMENT; provided <br />always however that the services to be provided by CONSULTANT shall be <br />provided in a manner consistent with all applicable standards and regulations <br />governing such services. <br /> <br />4. Scope of Services <br /> <br />A. POLICE FIREARMS SPECIALIST <br /> <br />CONSULTANT, in his capacity as a Police Firearms Specialist, shall: <br /> <br />1. Assist the Police Department in conducting firearms training and firearms <br />qualifications, including the development and writing of appropriate <br />firearms training lesson plans; <br /> <br />2. Inspect, provide maintenance, and repair Department-owned firearms and <br />officer-owned firearms that have been authorized for back-up or off-duty <br />use; <br /> <br />3. Review existing policies and procedures, and when needed recommend <br />and write new procedures and policies relating to Departmental weapons, <br />ammunition, holsters, and training procedures; <br /> <br />4. Work with outside law enforcement agencies (Federal, State, and <br />Municipal) in securing contracts for the rental of our range facility; <br /> <br />5. Monitor Range usage by all contract law enforcement agencies to ensure <br />training is done in compliance with our Department's established range <br />use and safety rules; <br /> <br />6. Provide instruction to all officers on the proper use and handling of their <br />weapons and related accessories and provide remedial firearms training <br />as needed; <br /> <br />7. CONSULTANT shall ensure the Range is maintained in a clean and safe <br />condition in compliance with applicable State and Federal requirements; <br /> <br />2 <br />
