<br />bk: 3/02/06 <br /> <br />RESOLUTION NO. 2006-011 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF SANTA ANA <br />CONSENTING TO THE PAYMENT OF THE COST OF <br />CONSTRUCTION OF A PUBLICLY OWNED IMPROVEMENT, <br />A PARKING LOT AT 2129 NORTH MAIN STREET, BY THE <br />COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF <br />SANTA ANA, PURSUANT TO SECTION 33445 OF THE <br />HEALTH & SAFETY CODE <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS <br />FOLLOWS: <br /> <br />Sedion 1: The City Council of the City of Santa Ana hereby finds, determines and <br />declares as follows: <br /> <br />A. The Community Redevelopment Agency of the City of Santa Ana <br />(hereinafter referred to as the "Agency") is engaged in activities necessary to <br />execute and implement the Redevelopment Plan for the Merged Project Area <br />(the Redevelopment Plan"), in the area formerly known as the Central City <br />Project Area. <br /> <br />B. Section I, Paragraph B of the Central City Redevelopment Plan, as <br />amended, states that the "provision of substantial offstreet parking" in the project <br />area is necessary to implement the objectives of the Plan. Section III, Paragraph <br />G.2. of said Plan further provides that the Agency is authorized to construct public <br />improvements and public facilities necessary to carry out the Plan. <br /> <br />C. The most recent Five Year Implementation Plan of the Agency further <br />provides that one of the prospective projects of the Agency for the period of July <br />2005 to June 2010 is: "Expansion of the Bowers Museum." <br /> <br />D. Section 33445 of the Health & Safety Code, part of the California <br />Redevelopment Law, provides that the Agency may pay for the cost of <br />construction of a public improvement, upon the consent of the City Council of the <br />City of Santa Ana ("City"), if the following findings can be made: <br /> <br />1. That the public improvement is of benefit to the project area or the <br />immediate neighborhood in which the project is located; <br /> <br />2. That no other reasonable means of financing the public improvement <br />is available to the community; and <br /> <br />Resolution No. 2006-011 <br />Page 1 of 4 <br />
