<br />. <br /> <br />A-2004-l59 <br /> <br />!:,L 1\U'i <br /> <br />, ~~ F f; <br /> <br />r\ <br /> <br />.:LU~( ~,\'., <br /> <br />~~n-ctl <br /> <br />SECOND AMENDMENT TO AGREEMENT <br />BETWEEN THE SANTA ANA EMPOWERMENT CORPORATION <br />AND THE SANTA ANA W/O!R!K CENTER <br />FOR USE OF EMPOWERMENT ZONE FUNDS <br /> <br />e eM <br />(rfI."~ <br /> <br />THIS SECOND AMENDMENT TO AGREEMENT ("Amendment") is entered <br />into this 23rd day of June, 2004, by and between the Santa Ana Empowerment <br />Corporation, a California non-profit public benefit corporation ("SAEC") and the City of <br />Santa Ana, a charter city and municipal corporation of the State of California, on behalf <br />ofthe Santa Ana W/O/RIK Center ("Subrecipient"). <br /> <br />Recitals: <br /> <br />A. The parties entered into an Agreement dated July 1,2003, (hereinafter "said <br />Agreement") by which SAEC granted to Subrecipient, Empowerment Zone ("FEZ") <br />funds granted to SAEC from the United States Department of Housing and Urban <br />Development. <br /> <br />B. On or about April 5, 2004, the parties entered into a first amendment to said <br />Agreement, which added $12,000 in first year funds to the Subrecipient for marketing <br />and outreach efforts. <br /> <br />C. The parties now wish to provide for a second year of programs, as specified in greater <br />detail in Exhibit B to this Amendment. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Agreement, the parties agree as follows: <br /> <br />1. Section 1. A., SUBRECIPIENT'S OBLIGATIONS, shall be amended shall be <br />amended to add a new subparagraph A.2. which shall read as follows: <br /> <br />"Subrecipient agrees to use all federal funds provided by SAEC during the 2004- <br />2005 fiscal year, in conformance with the Service Navigator Segment Work plan, <br />"Scope of Work," and "Budget Form," all of which attached hereto as Exhibit B <br />hereto, to increase the funds available to Subrecipient for carrying out the <br />program for a maximum aggregate payment of Nine Hundred Eighty Thousand <br />Dollars ($980,000.00) during fiscal year 2004-2005. <br />
