Contractor and City entered into a Lease Agreement by which Contractor leases <br />to City that property known as 1602 N. Grand Avenue, Santa Ana, California, <br />(hereinafter "said Property"), for City's use thereof as an animal shelter. <br /> <br />B. The City desires to retain Contractor to provide carcass removal services for said <br />Property. <br /> <br />C. Contractor represents Contractor is able and willing to provide such services at a <br />lower cost to the City than City can obtain directly contracting with the carcass <br />removal service. <br /> <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject <br />to the terms and conditions hereinafter set forth, the parties agree as follows: <br /> <br />I. SCOPE OF SERVICES <br /> <br />Contractor shall contract with D & D Disposal to provide carcass removal <br />services for said Property. <br /> <br />2. COMPENSATION <br /> <br />City agrees to pay, and Contractor agrees to accept as total payment for its <br />services, $175.00 per month. The total sum to be expended under this Agreement shall <br />not exceed $4200.00 during the term of this Agreement. <br /> <br />Payment by City shall be made on or before the fifth day of the first full calendar <br />month of the term hereof and like sum on or before the first day of each successive <br />calendar month thereafter during the term hereof. <br /> <br />3. TERM <br /> <br />This Agreement shall commence on the date first written above and terminate on <br />December 31,2003, unless terminated earlier in accordance with Section 7, below. The <br />term of this Agreement may be extended upon a writing executed by the Chief of Police <br />and the City Attorney. <br />
