City and Consultant entered into a Consultant Agreement, dated August 26, 2002, <br />by which Consultant agreed to provide contract inspection services (the "Agreement"). <br /> <br />B. The Parties now desire to amend the Agreement to increase the compensation by <br />an additional $35,000.00 for the above services. <br /> <br />WHEREFORE, in consideration of their mutual and respective promises, and subject to <br />the terms and conditions of the Agreement as hereby amended, the parties hereby agree as <br />follows: <br /> <br />I. Section 2(a) of the Agreement is amended to read as follows: <br /> <br />"a. City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The total sum to be expended under this <br />Agreement, shall not exceed $ 45,000.00 during the term of this Agreement." <br /> <br />2. Except as hereinabove modified, the terms and conditions of the Agreement <br />remain in full force and effect. <br /> <br />(Signatures on following page) <br />
