<br />CITY COUNCIL MEETING DATE: <br /> <br />~ <br />~ <br /> <br />REQUEST FOR <br />COUNCIL ACTION <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />MAY 1, 2006 <br /> <br />APPROVED <br /> <br />TITLE: <br /> <br />ADOPT AN ORDINANCE TO <br />REGULATE PROXIMITY OF <br />REGISTERED SEX OFFENDERS TO <br />CHILDREN'S FACILITIES <br /> <br /> <br />~. <br /> <br />CITY ANAGER <br /> <br />o As Recommended <br />o As Amended <br />o Ordinance on 151 Reading <br />o Ordinance on 2nd Reading <br />o Implementing Resolution <br />o Set Public Hearing For <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />RECOMMENDED ACTION <br /> <br />Adopt an ordinance adding Article 12, Sections 10-700 through 10-703 to <br />the Santa Ana Municipal Code regulating the proximity of registered sex <br />offenders to children's facilities. <br /> <br />DISCUSSION <br /> <br />The City of Santa Ana desires to add local restrictions prohibiting sex <br />offenders from loitering in areas that are primarily designed for use by or <br />primarily used by children. The state law regulating sex offenders is <br />silent in this regard. <br /> <br />Government reports show that the median age of the victims of imprisoned <br />sexual assaulters is less than 13 years old. Studies have shown that sex <br />offenders pose a high risk of re-offending. There are currently <br />approximately 385 registered sex offenders residing in Santa Ana and over <br />two-thirds of these offenders have victimized persons under the age of 18 <br />years of age. <br /> <br />The proposed ordinance would prohibit any sex offender from being on or <br />within 300 feet of a school, a day care center, or park while there for the <br />apparent purpose of observing a child or children, or while loitering, or <br />returns at any time after having been told to leave by the owner or any <br />authorized official of such place or facility. Any registered sex offender <br />subj ect to this ordinance will be notified of the new ordinance. The <br />attached map shows current registered sex offenders and the 300 feet buffer <br />zones from children's facilities (Exhibit 1). <br /> <br />As the City places a high priority on the safety of children, it is <br />recommended that this ordinance be adopted to reduce the potential risk of <br />harm to children. <br /> <br />50A-1 <br /> <br />
