4. TERM (2.2 S) <br />2 <br />The term of this Lease shall be Ten (10) years, commencing the first day of the first full calendar <br />4 month following the date of execution by COUNTY, or commencing the first day of the first full calendar <br />month following the completion by LESSOR of the work set out in Clause 8 entitled (CONSTRUCTION), <br />6 below, whichever date is later. <br />8 Parties agree that the commencement date of this Lease will be confirmed in writing by either party upon <br />demand by the other. <br />10 <br />12 B. Clause 7. (RENT ADJUSTMENT) is deleted in its entirety from the Lease and the following is <br />substituted: <br />14 <br />7. RENT ADJUSTMENT (3.313 N) <br />16 <br />COUNTY's monthly rent payments shall be subject to automatic adjustment at the beginning of the <br />18 2 n 4th 7tH Stn I hn 13tH, 15" year(s) of the lease term. Said adjustment shall be proportionate to the change <br />in the Consumer Price Index for Los Angeles—Anaheim—Riverside (All Urban Consumers—All Items, <br />20 1982-84 = 100) promulgated by the Bureau of Labor Statistics of the U.S. Department of Labor or any <br />replacement index thereto for the period of time between the commencement date of the lease term and the <br />22 adjustment date. The increase or decrease shall be calculated by means of the following formula: <br />24 Adjusted Rent = A x B <br />C <br />26 A= $7,307.10 <br />B = Monthly index for the fourth month prior to the month in which the rent increase is to become <br />28 effective. <br />30 C = Monthly index for the fourth month prior to the month in which the lease term commences. <br />32 Notwithstanding the above, the Adjusted Rent shall not exceed 105% of the previous monthly rent. <br />34 C. Clause 10 (ALTERATIONS) is deleted in its entirety from the Lease and the following is substituted: <br />36 10. ALTERATIONS (4.4 N) <br />38 COUNTY may make improvements or request LESSOR, in LESSOR's sole discretion, to make <br />improvements and changes in the Premises, including but not limited to the installation of fixtures, <br />40 partitions, counters, shelving, and equipment as deemed necessary or appropriate with written consent of <br />LESSOR, which shall not be unreasonably withheld. It is agreed that any such fixtures, partitions, <br />42 counters, shelving, or equipment attached to or placed upon the Premises by COUNTY or LESSOR at <br />COUNTY request shall be considered as personal property of COUNTY, who shall have the right to <br />44 remove same.
