LE 00lJNCIL AGREEMENT BETWEEN THE CITY OF SANTA ANA <br />'?~` ~ $.1~~ ~~ AND THE ORANGE COUNTY CONSERVATION CORPS <br />~ • ~~ ~`~~ THIS AGREEMENT, made and entered into this 3`d day of April 2006 by and between <br />C~'(inµ' the Orange County Conservation Corps, a California non-profit corporation (hereinafter <br />"OCCC"), and the City of Santa Ana, a charter city and municipal corporation duly organized <br />and existing under the Constitution and laws of the State of Califomia (hereinafter "CITY"). <br />RECITALS <br />A. The CITY desires to assist in the development of a local conservation corps to help "at <br />risk" youth acquire career skills and work experience, while continuing their education, <br />thereby addressing problems with gangs and illicit drugs; and <br />B. CITY received grant funding from the State of California to implement Urban Stream <br />Restoration Projects; and <br />C. CITY needs assistance in 1) the removal and re-landscaping along Santiago Creek and <br />2) the clearing and site preparation to restore wetland and riparian habitat at Thornton <br />Park. The CITY has determined that these services can be performed by OCCC; and <br />D. OCCC is ready, willing and able to supply persons between 17-25 years of age to train <br />and perform certain services for the CITY under the terms and conditions set forth <br />herein. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafer set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />OCCC shall provide labor, supervision, adequate crew to complete the Projects; tools, <br />crew equipment, and corps members' safety items to perform those tasks requested by the <br />Executive Director of Parks, Recreation and Community Services Agency, and/or his/her <br />designee ("Director"), which OCCC is able to perform. <br />The Santiago Creek Project will include the removal and re-landscaping along Santiago <br />Creek from Santiago Bridge to the 22 Freeway. The assignments contemplated herein include, <br />but are not limited to, re-contouring the banks and slopes of Santiago Creek with hand tools, <br />removal of exotic vegetation, and planting of native vegetation. Additionally, OCCC shall be <br />involved in two half-day training workshops. <br />The Thornton Park Project will include clearing the site and preparing the site so <br />improvements may be completed. Such site preparation will included some grading of the slope. <br />2. COMPENSATION <br />a. City agrees to pay, and OCCC agrees that the total sum to be expended for the <br />Santiago Creek Project shall not exceed Eighty Thousand Dollars ($80,000.00) and the total sum <br />to be expended for the Thornton Park Project shall not exceed TenThousand Dollars <br />
