Koo & Associates ("Consultant') and the City of Santa Ana, a charter city and municipal <br />corporation of the State of California ("City"). <br />RECITALS <br />A. The Parties entered into Agreement A-2005-012, dated January 18, 2005, hereinafter <br />referred to as "said Agreement', to provide structural plans, specifications and estimates for <br />three City bridges and a cantilever bike trail structure; and <br />B. The Parties hereto now desire to amend the term to allow for the work to be completed <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter <br />contained and made, and subject to all of the terms and conditions of said Agreement as hereby <br />amended, the parties hereto do hereby agree as follows: <br />Section 4, "TERM", is hereby deleted in its entirety and replaced with the following: <br />"Agreement shall commence on the date first written above and terminate on completion of <br />the services set forth in Section 1, above, unless terminated earlier in accordance with <br />Section 13, below." <br />2. Except as hereinabove modified, the terms and conditions of said Agreement remain <br />unchanged and in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to Agreement <br />the date and year first above written. <br />APPROVED AS TO FORM: <br />r <br />f°� OSEPH W.
