<br />F. Similarly, in a few limited circumstances, new charges have been added <br />or existing charges raised beyond this 5.3% cost of providing services. In each of these <br />cases, the Council further finds, determines and declares that such new or increased <br />charges, fees or service charges do not exceed the City's estimated reasonable cost to <br />provide the pertinent service, process the specified application or administer the certain <br />program for which the charge, fee or service charge is imposed. <br /> <br />G. In order to have a single comprehensive document for Fiscal Year 2006- <br />2007, the majority of fees which are unchanged have simply been reprinted in the <br />Miscellaneous Fee Schedule. The Council expressly states that it is not its intention to <br />repeal previously adopted fees and adopt new fees of exactly the same amount, but is <br />simply repeating these fees so that the Miscellaneous Fee Schedule can continue to be <br />a comprehensive source of City fees and service charges. <br /> <br />H. As to the City's Metered Water Rates the Council finds, declares and <br />determines: <br /> <br />1. Santa Ana Municipal Code, Chapter 39, Article II regulates <br />connection to water mains within the City. <br /> <br />2. Pursuant to Santa Ana Municipal Code section 39.21 the <br />City Council shall set metered water rates by resolution. <br /> <br />3. The metered water rate shall be set to maintain a potable <br />water supply and provide standby readiness. <br /> <br />4. The rate increase over and above CPI will be used to <br />reimburse the City for increases in the cost of purchasing water from the Metropolitan <br />Water District of Southern California, which is identified in a report prepared by the City, a <br />true and correct copy of which is on file with the Clerk of the Council. <br /> <br />I. As to the City's sanitary sewer service rates which are increased in this <br />year's Miscellaneous Fee Schedule, the Council finds that as to this fee: <br /> <br />1. Santa Ana Municipal Code, Chapter 39, Article III regulates <br />connection to sewer mains within the City. <br /> <br />2. Pursuant to Santa Ana Municipal Code section 39.55.4 the <br />City Council shall set reasonable sewerage service fees by resolution. <br /> <br />3. The rate increase over and above CPI will be placed into a <br />fund that would be used only to repair and replace sewer mains and laterals located <br />within the street right of way, and which have outlived their useful life. No moneys from <br />this fund would be placed in the city's general fund. <br /> <br />4. There is a reasonable relationship between the imposition of <br />the fee imposed in that the use of the sewer creates an impact on its condition, requiring <br />its repair and replacement. <br /> <br />Resolution <br />Page 2 of 4 <br /> <br />75A-13 <br />
