<br />LES 5/25/06 <br /> <br />RESOLUTION 2006- <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AUTHORIZING THE CITY <br />ENGINEER TO EXECUTE THE. RACE-NEUTRAL <br />DISADVANTAGED BUSINESS ENTERPRISE <br />IMPLEMENTATION AGREEMENT AND ANY <br />FUTURE AGREEMENTS WITH THE CALIFORNIA <br />DEPARTMENT OF TRANSPORTATION <br />REGARDING CHANGES OR AMENDMENTS TO <br />TITLE 49 OF THE CODE OF FEDERAL <br />REGULATIONS <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. The Public Works Agency has been required to update the Disadvantaged <br />Business Enterprise (DBE) Program annual goal which involved federally funded <br />projects administered by the State of California Department of Transportation <br />("Caltrans") on an annual basis. <br /> <br />B. Recent changes in Title 49 of the Code of Federal Regulations require the <br />City to execute a Race-Neutral DBE Implementation Agreement in order to meet <br />the local agency's responsibilities under the new Race-Neutral DBE Program. <br /> <br />C. In accordance with the new DBE Program, as with the previously adopted <br />DBE Program, a resolution is needed to designate the City Engineer as the DBE <br />Liaison Officer, and to authorize the City Engineer to execute the Race-Neutral <br />Implementation Agreement and any future amendments or agreement changes <br />regarding Title 49 of the Code of Federal Regulations, Part 26. <br /> <br />Section 2. The City Council hereby designates the City Engineer as the DBE <br />Liaison Officer and authorized the City Engineer, and the City Attorney, to execute the <br />Race-Neutral DBE Implementation Agreement with the State of California Department <br />of Transportation, as required by Title 49 of the Code of Federal Regulations, Part 26. <br /> <br />Section 3. The City Council hereby authorizes the City Engineer, and the City <br />Attorney, to execute any amendments or agreement changes with the State of <br />California Department of Transportation required by Title 49 of the Code of Federal <br />Regulations, Part 26. <br /> <br />Resolution <br />Page 1 of 2 <br /> <br />55A-3 <br />
