F. Students under this Agreement are not employees of the DISTRICT or the FACILITY. G. DISTRICT instructional staff is covered by Workmen's Compensation provided by the DISTRICT. The FACILITY shall have no obligation to provide any Workmen's Compensation benefits for the faculty or students. II. RESPONSIBILITIES AND PRIVILEGES OF THE FACILITY A. The FACILITY shall maintain standards, which make it eligible for approval as a "FACILITY" for students enrolled in the program. B. The FACILITY shall permit the instructional staff and students of the DISTRICT to utilize the facilities as agreed to in the plan for instruction, agreed to by the FACILITY and DISTRICT. C. The FACILITY shall designate a person to serve as coordinator and liaison between the FACILITY and the instructional staff of the DISTRICT. D. The FACILITY shall provide the following physical facilities for the students of the DISTRICT: (1) Reasonable use of parking areas to the FACILITY. DISTRICT shall hold Lessor, its officers, agents, and employees free and harmless from any claim or demand made and every liability, loss, damage, or expense of any nature whatsoever which may be incurred by reason of any damage to property, including Lessor's property, or death or injury to persons arising out of the District's use of said facility and resulting from the negligent or willful misconduct of the District, its officers, employees, or agents. LESSOR shall hold District, its officers, agents, and employees free and harmless from every claim or demand made and every liability, loss, damage, or expense of any nature whatsoever which may be incurred by reason of any damage to property, including the District's property, or death or injury to persons arising out of the District's use of said facility and resulting from the negligent or willful misconduct of Lessor, its officers, employees, or agents, or from any dangerous or defective condition of the facility or premises.
