Tenant undertakes and agrees to use the Premises at all times in <br />such manner as will not unreasonably interfere with the full use and <br />enjoyment of the Property by Landlord and the public. <br />(c) As a covenant to this Agreement, Tenant shall adhere to and comply with <br />all responsibilities enumerated in Rider 1, attached hereto and <br />incorporated herein. <br />(d) Tenant must keep on file with the City of Santa Ana a copy of any <br />agreements with any subsidiaries. <br />Section 1.02 Term <br />The term of this Agreement ("Term") shall be five (5) years commencing on <br />October 1, 2003 ("Commencement Date") and terminating on September 30, <br />2008. Earlier termination of this Agreement shall be in conformance with Section <br />5.02. Notice of intent to vacate or termination of the landlord -tenant relationship <br />is only valid with thirty (30) days prior written notice to the other party. <br />Section 1.03 Rent <br />(a) Tenant shall pay to Landlord total monthly compensation in the amount of <br />$6,400.00. Said amount is comprised of monthly rent in the amount of <br />$5,400.00 per month, plus $950.00 for common area maintenance fees. <br />Rent will be due upon execution of this Agreement and thereafter on or <br />before the 10th of each month, payable to "The City of Santa Ana" and <br />remitted to: The Depot at Santa Ana, 1000 East Santa Ana Blvd., Suite <br />108, Santa Ana, CA 92701. A late charge of ten percent (10%) shall be <br />applied after any payment hereunder is due but unpaid. In addition, one <br />and a half percent (1 %%) interest per month shall be added for each <br />month that payment hereunder is due but unpaid. <br />(b) Greyhound's monthly rental payments shall be subject to an automatic <br />adjustment increase in the 2nd and 4th years of the term. At the second <br />year anniversary (Oct. 1, 2005) rent shall increase to $6,500.00 total, and <br />at the 4th year anniversary (Oct. 1, 2007) the increase shall be an additional <br />1.5%. <br />(c) Any holding over after the expiration of the Term, with the consent of <br />Landlord, shall be construed to be an extension from month to month <br />under the same terms and conditions herein specified, so far as applicable. <br />Section 1.04 Non -Recording <br />Neither party shall record this Agreement. <br />
