<br />6/27/06Ies <br /> <br />RESOLUTION NO. 2006-042 <br /> <br />A RESOLUTION APPROVING THE SUMMARY VACATION <br />OF THE OFFER OF DEDICATION OF THE UNNAMED <br />STREET EAST OF JACKSON STREET BETWEEN <br />ELEVENTH STREET AND WASHINGTON AVENUE <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds <br />determines and declares as follows: <br /> <br />A. The City of Santa Ana intends to vacate the offer of dedication for the <br />unnamed street east of Jackson Street between Eleventh Street and <br />Washington Avenue pursuant to and in accordance with the provisions of <br />Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the <br />State of Caiifornia. <br /> <br />B. The vacation of the unnamed street is a summary vacation because the street <br />lies within property under one ownership pursuant to the provisions of section <br />8334 of the Streets and Highway Code of the State of Caiifornia. All property <br />adjacent to said unnamed street are owned in fee by a developer, and said <br />property will be subdivided in accordance with Tentative Tract Map No. 16576 <br />for 1101 through 1119 North Jackson Street, approved by Council on August <br />2,2004. <br /> <br />C The land being subdivided by Tract Map No. 16576 contains a strip of land <br />which is subject to a continuing offer of dedication to the City for future use as <br />Jackson Street. The offer was made by the previous subdivider on Tract Map <br />NO.1 022, which recorded on May 2, 1940. The City never accepted the offer <br />of dedication and instead obtained the right of way for and constructed <br />Jackson Street two hundred (200) feet west of the subject offered land. This <br />vacation will terminate all vehicular rights to this unnamed street <br /> <br />D. In accordance with the Caiifornia Environmental Quality Act, the proposed <br />vacation has been determined to be adequately evaluated in the previously <br />prepared Mitigated Negative Declaration ER No. 2003-133 adopted by <br />Council in 2004. <br /> <br />Section 2. The City Council of the City of Santa Ana hereby approves the <br />summary vacation of the unnamed street east of Jackson Street between Eleventh <br />Street and Washington Avenue, as more particularly described in Exhibit 1 attached <br />hereto and incorporated herein by reference. In addition, the City expressly rejects and <br />declines to accept any outstanding offer of dedication for said street. <br /> <br />Resolution No. 2006-042 <br />Page 1 of 3 <br />
