<br />Lss062706 <br /> <br />- <br /> <br />RESOLUTION NO. 2006-045 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />ESTABLISHING A RECORDS RETENTION SCHEDULE <br />FOR THE AGENCIES, DEPARTMENTS AND OFFICES OF <br />THE CITY <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. Except for records less than two years old and certain other, specified records, <br />Government Code section 34090 authorizes the head of city departments to <br />cease retaining records, documents, instruments, books or paper under his or <br />her charge, without keeping a copy thereof, with the approval of City Council <br />and the written approval of the City Attorney. <br /> <br />- <br /> <br />B. Government Code section 34090.5 authorizes the head of a city department, <br />without the approval of the City Council and the written approval of the City <br />Attorney, to destroy records, documents, instruments, books or paper if the <br />record, paper or document is accurately and legibly reproduced on film or any <br />other medium that is a trusted system and that does not permit additions, <br />deletions, or changes to the original document, and the reproductions are made <br />as accessible for public reference as the original records were. <br /> <br />C Government Code section 34090.6 allows the head of a city department, with <br />the approval of the City Council and the written approval of the City Attorney, <br />to destroy recordings of routine video monitoring after one year. That section <br />further authorizes the head of a city department to destroy recordings of <br />telephone and radio cornmunications maintained by the department after 100 <br />days. It is the intent of the City to maintain the audio recordings for six <br />months in accordance with the Tort Claim filing requirement. <br /> <br />D. The City Council desires to establish a retention schedule for records under <br />the control of the executive officers in charge of various city agencies, <br />departments and offices and to approve destruction of records in accordance <br />therewith. <br /> <br />Section 2.
