WORK MAY WI PROCEED <br />CLERK OF COUNCIL N-2002-150-03 <br />DATE: 7.,5'06 <br />0:SAP017rz iAAg bN THIRD AMENDMENT TO CONSULTAN f AGREEMENT <br />muDret4+ cii) <br />THIS THIRD AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into this 28°i day of June, 2006, by and between Paul Fetters dba The Training Spot, a <br />California corporation ("Consultant') and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br />RECTI ALS: <br />A. The parties entered into Agreement N2002-150 dated October 4, 2002, (hereinafter <br />"said Agreement") by which Consultant has provided health and fitness classes to the <br />City's Police Department. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />renew said Agreement for an additional one-year term. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Third Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 3, TERM, shall be extended for an additional one-year term, through June <br />30. 2007. <br />2. Section 5.a. "Commercial General Liability Insurance", shall be deleted in its <br />entirety. The services to be provided do not require the provision of such insurance. <br />IN WITNESS WHEREOF, the parties hereto have executed this Third Amendment to <br />Consultant Agreement on the date and year first written above. <br />PATRICIA F.
