RECITALS: A. The parties entered into Agreement N-2003-155, dated September 1, 2003, (hereinafter "said Agreement') by which Consultant has provided architecture and urban design services. B. In accordance with the terms and conditions of said Agreement, the parties wish to amend the Scope of Services and increase compensation to pay for the additional services. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Third Amendment to Consultant Agreement, the parties agree as follows: Section 1, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with the following: "Consultant shall provide architectural and urban design services as requested by the Santa Ana Planning and Building Agency, as set forth in Exhibit A to said Agreement, Exhibit A-1 of the First Amendment to Agreement and Exhibit A-2, attached hereto." 2. Section 2, COMPENSATION, shall be amended in its entirety to read as follows: "City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibits A, A-1 and A-2. The total sum to be expended under said Agreement shall not exceed $76,000.00 during the term of said Agreement." 3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force and effect.
