Sec. 14-4.5. Same -Costs. <br />The FCC-certified technician is the special inspector who shall be employed by the <br />owner, the engineer or architect of record, or agent of the owner, but not the contractor <br />or any other person responsible for the building or structure construction. <br />Sec. 14-4.6. Same -Non-compliance and Penalty. <br />A. After discovery of non-compliance, the building owner shall be provided forty- <br />five (45) days from written notification by the Fire Chief or designee to remedy <br />the deficiency and gain compliance. <br />B. It shall be unlawful for any person, firm or corporation to violate any provision <br />or fail to comply with any of the requirements of this ordinance. Any person, <br />firm or corporation violating any provisions of this ordinance or failing to <br />comply with any of its requirements shall be deemed guilty of an infraction, <br />punishable by fine not exceeding Two Hundred and Fifty Dollars ($250.00) <br />per day. Each such person, firm or corporation shall be deemed guilty of a <br />separate offense for each day during any portion of which any violation of any <br />of the provisions of this ordinance is committed, continues or permitted by <br />such person, form or corporation, and shall be punishable therefore as <br />provided for in this ordinance. <br />Section 4. If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the remaining <br />portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it <br />would have adopted this ordinance and each section, subsection, sentence, clause, phrase <br />or portion thereof irrespective of the fact that any one or more sections, subsections, <br />sentences, clauses, phrases, or portions be declared invalid or unconstitutional. <br />ADOPTED this day of , 2006 <br />Miguel A.
