FIFTH AMENDMENT TO CONSULTANT AGREEMENT RECITALS: A. The parties entered into Consultant Agreement N-2002-048, dated Fehruary 28, 2002, (hereinafter "said Agreement") by which Consultant has provided counseling and inSlnlctional services to the inmates at the Santa Ana City Jail. B. The parties amended said Agreement (N-2002-!28 dated August!, 2002, N-2003- 071 dated July 1,2003 and N-2004-090 dated July 1,2004) to increase the compensation and extend the term. C. In accordance with the terms and conditions of said Agreement, the parties wish to renew said Agreement for an additional one-year period. WHEREFORE, in consideration ofthe covenants contained in said Agreement, and suhject to all the terms and conditions of said Agreement. as previously amended, except thu~e amended in this Fifth Amendment to Consultant Agreement, the parties agree as follows: I. Section 2,a" COMPENSATION, shall he deleted in its entirety and replaced with the following: "a. City agrees to pay, and Consultant agrees to accept as total payment for its services. an hourly rate ofthil1y-seven dollars ($37,00) for all scheduled instructional and counseling sessions. The total sum to be expended under this Agreement shall not exceed $10,000,00, annually, during the term ufthis Agreement" 2, Section 3, TERM, shall be amended to extend the termination date nne year, hum June 30, 2006 through June 30, 2007, 3.
