officers and employees as insured or additional insured. <br />XXIII PERFORMANCE PERIOD <br />1. The contract shall begin upon approval by the City Council, and the <br />Consultant shall commence work after notification to proceed by the City. <br />Unless extended by contract amendment, the contract shall terminate <br />upon acceptance by the City of the project as constructed and upon <br />completion by the Consultant and approval of the City of the as -built <br />plans. <br />2. The Consultant is advised that any recommendation for contract award is <br />not binding on the City until the Agreement is fully executed and approved <br />by the City Council. <br />XXIV ESTABLISHING OF FEES <br />A fee proposal is to be submitted separately in a sealed envelope plainly <br />labeled "Fee Proposal". The fee proposal will not be opened until the <br />consultants have been evaluated by the proposal selection committee. In <br />conformance with the Brooks Act, the Cities will select the consultant based <br />on qualifications, then negotiate a contract price based on available funding, <br />and a further breakdown of the not -to -exceed cost submitted in the fee <br />proposal. <br />The fee proposal shall show personnel needed for each task required for all <br />plan types along with their billing rate and anticipated hours of work for each <br />specific task. <br />XXV EXAMINATION OF SITE PRIOR TO SUBMITTING PROPOSAL <br />Consultants must inform themselves fully of the conditions relating to the <br />project and the employment of labor thereon. Failure to do so will not relieve <br />a successful consultant of the obligation to carry out the provisions of the <br />contract. <br />iL� <br />
