N_2006-037-01 HRST AMENDMENT TO AGREEMENT RECITALS: A. The par lies entered into Agreement N-2006-037, dated May 1,2006. (hereinafter "said Agreement") by which Consultant has provided tree lighting maintenance for the Artist Village Tree Lighting Program. R. In accordance with thc terms and conditions of said Agreement. the parties wish to amend the Scope of Service, increase compensation to pay for new servi\,;es and extend the term of said Agreement for an additional six-month period. WHEREFORE. in consideration of the covenants contained in said Agreement. and suhject to all the terms and conditions of said Agreement, ex.ccpt those amended in this First Amendment to Consultant Agreement, the parties agree as follows: 1. Section 1. SCOPE OF SERVICES, shall be amended to add a second paragraph La. which will read, in full, as follows: "Consultant shall provide flag and skyline banner installation services as set forth in Exhibits A- I and A-2, respectively, attached hereto and incorporated by referetlee." 2. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the following: "City agrees to pay. and Consultant agrees to accept as total payment for its services. the rates and charges identilled in Exhibit A, A-I and A-2. respectively. The total sum to be expended under said Agreement. as amended, shall not exceed $10,000.00 during the term of said Agreement." 3. Section 3, TERM. shall be amended to extend the termination date to June 30, 2007. 4. Except as herein amended. all terms and conditions of said Agreement shall remaining full force and elfect. II II
