REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />OCTOBER 2, 2006 <br />TITLE: <br />ABANDONMENT NO. 06-03-5: TO VACATE <br />LEONARD LANE WEST OF FREEMAN LANE <br />~- <br />CITY MANAGER <br />,//RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 1S' Reading <br />^ Ordinance on 2nd Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Adopt a resolution vacating Leonard Lane west of Freeman Lane. <br />DISCUSSION <br />The applicant, Camille Paula Bauer, has requested the City vacate Leonard <br />Lane, which is approximately 30 feet by 105.51 feet, directly west of <br />Freeman Lane. (See Exhibit 1) This abandonment will be processed as a <br />summary vacation since the City right-of-way has not been utilized for <br />more than 5 years and lies adjacent to the Bauer property located at 2738 <br />Freeman Lane. <br />Leonard Lane is not necessary for public traffic and/or pedestrian <br />circulation. Upon abandonment, the applicant will consolidate the <br />mentioned portion of the street and use as a driveway to their garage. <br />All affected utility companies have been contacted and do not object to <br />the abandonment. There is no existing overhead or underground utilities <br />within the proposed vacated area. The proposed resolution will abandon <br />Leonard Lane with no easement reservations. <br />ENVIRONMENTAL IMPACT <br />In accordance with the California Environmental Quality Act, a Mitigated <br />Negative Declaration has been prepared for this project (ER No. 2006- <br />154) . <br />12A-1 <br />
