E. WEEDS, DISEASE AND PEST CONTROL <br />1. Weed Control <br />a. All landscape and hardscape areas within the specified scope of <br />work (including, but not limited to, turf, shrub and ground cover, <br />planters, tree wells, ornamental bark or rock areas, sidewalk, asphalt <br />or concrete areas) shall be kept free of weeds and foreign grasses at <br />all times. The complete removal of all weed growth shall be <br />accomplished on a continuing basis. Weeds shall be controlled by <br />hand and approved mechanical or chemical methods. Should weeds <br />two (2) inches or greater not be removed within forty eight (48) <br />hours after the request of the Director, the Director reserves the <br />right to dispatch City forces to remove the weeds. The cost of <br />estimated labor and overhead to be realized by the City shall then be <br />deducted from the Contractor's monthly payment. <br />b. The transferring of weeds or disease from one infected turf, plant or <br />tree to another turf, plant or tree through improper or faulty <br />maintenance shall be considered Contractor negligence. <br />i. Such negligence includes but is not limited to, non- <br />cleaning or non-disinfecting of tools or equipment and for <br />not isolating the infected area. <br />ii. All effected turf, plant, or tree shall be replaced by <br />Contractor at no cost to the City. <br />2. Disease and Pest Control <br />a. The Contractor shall regularly inspect all landscaped areas for <br />presence of disease, insect or rodent infestation. The Contractor <br />shall advise the Director within forty eight (48) hours when disease, <br />insect or rodent infestation is found, and the action to be taken. <br />Upon approval of the Director, the Contractor shall implement <br />approved control measures, following all Federal, State, County, and <br />municipal laws, regulations and ordinances required for the <br />approved work. <br />b. Approved control measures shall be continued until the disease, <br />insect or rodent is controlled to the satisfaction of the Director. The <br />Contractor shall utilize all safeguards necessary during disease, <br />insect or rodent control operations to ensure safety of the public and <br />the employees of the Contractor. <br />c. Any plant, turf or tree material which dies without the Contractor's <br />Horticulturist and/or ISA certified Arborists diagnosing the plant, <br />turf or tree and implementing efforts to save the plant, turf or tree <br />will be considered Contractor negligence and shall be replaced by <br />Contractor at no cost to the City. <br />23 <br />
