<br />.' <br />:'L;.Ui' <br /> <br />!U <br /> <br />A-2006-245 <br /> <br />C .1,-, L[U <br />;(,:".! ;t LX;!iRf,~> <br /> <br />a ~ .. :{:: (;/!~___,_ <br /> <br />{' "~ .{. <br />7- o<..~--LJLO <br /> <br />FOURTH AMENDMENT TO AGREEMENT <br /> <br />D. r1NO) <br />. ) <br />{~~.L~ <br /> <br />THIS FOURTH AMENDMENT, made and entered into this 5th day of September, 2006, by and <br />between Pacific Systems Electric ("Consultant") and the City of Santa Ana, a charter city and municipal <br />corporation duly organized and existing under the Constitution and laws of the State of California <br />("City"), collectively referred to herein as "the Parties". <br /> <br />RECITALS: <br /> <br />A. The Parties entered into Agreement #A-2004-239, dated November 15, 2004, hereinafter <br />referred to as "said Agreement", for inspection and preventive maintenance of underground fuel <br />storage tanks. <br /> <br />B. Results of the mandatory inspection and testing revealed that additional repairs are required in <br />order to remain in compliance with AQMD standards. <br /> <br />C. The Parties hereto now desire to amend the Scope of Services and increase the Compensation <br />to provide for repairs to underground tanks in order that they remain in compliance with <br />AQMD standards. <br /> <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter <br />contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, <br />the parties hereto do hereby agree as follows: <br /> <br />L Section I, SCOPE OF SERVICES, shall be amended to provide that Consultant shall perform <br />services as set forth in Consultant's letters dated June 21, 2006, June 23, 2006 and June 27, 2006, <br />attached hereto as Attachments 1,2 and 3, respectively, and incorporated by reference. <br /> <br />2. Section 2.a, COMPENSATION, is hereby amended to increase the compensation by adding <br />$80,000.00 for a total amount not to exceed $166,942.54 during the term of said Agreement. <br /> <br />3.
