3.2 warranty for Third Party Products. The Contractor makes no <br />warranty with respect to any software or hardware components <br />specified in the Project Deliverables other than the TriTech <br />Applications. Warranty coverage for Third -Party Products <br />shall be passed through to the City and provided in <br />accordance with the original manufacturers' warranty <br />provisions. The Contractor shall perform Help Desk services <br />(as that term is defined in Exhibit F) for Third -Party items <br />provided by Contractor hereunder. For any equipment or other <br />Third Party product specified in the Project Deliverables <br />and provided by TriTech under this Agreement that is no <br />longer available at the time of order due to model changes <br />or other reasons beyond the reasonable control of TriTech, <br />TriTech shall provide equipment of same or equal quality, <br />performance and capacity. <br />3.3 Documentation. The Contractor shall provide current and <br />accurate Documentation with respect to each TriTech <br />Application, including, without limitation, training <br />materials for each TriTech Application and sufficient copies <br />thereof, as prescribed in the Statement of Work. It is the <br />intent of the parties that the training materials be written <br />in a manner so that City personnel may utilize the materials <br />as a reliable resource for understanding the System's <br />operations. <br />3.4 TRITECH MAKES AND CITY RECEIVES NO OTHER WARRANTIES, EXPRESS <br />OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED <br />WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR <br />PURPOSE. <br />Primary Agreement Page 13 <br />
