A-2006-231 <br />FIRST AMENDMENT TO SIGNAL <br />INTERCONNECT AGREEMENT <br />THIS FIRST AMENDMENT TO SIGNAL INTERCONNECT AGREEMENT is <br />entered into this 22nd day of August 2006, by and between Union Pacific Railroad <br />Company, a Delaware corporation ("Railroad") and the City of Santa Ana, a charter city <br />and municipal corporation of the State of California ("City"). <br />RECITALS: <br />A. The parties entered into the Signal Interconnect Agreement A-2002-218 dated <br />October 1, 2002, (hereinafter "said Agreement") by which Railroad has provided <br />traffic safety upgrades at the railroad crossing to provide advanced warning that a <br />train is approaching for the traffic signal at Alton Avenue and Greenville Street. <br />B. The parties had an original estimate for the work, however the Railroad's actual costs <br />to perform the work exceeded their original estimate by Four Thousand Seven <br />Hundred Thirty Six Dollars and Thirty Four Cents ($4,736.34). The parties hereto are <br />amending the Agreement to include these additional monies outstanding and due For <br />the work performed by the Railroad. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Amendment to Signal Interconnect Agreement, the parties agree as follows: <br />t. Section 1, Subsection d. shall be amended by increasing the total amount of <br />compensation to be paid by City to Railroad by the amount of $4,736.34. <br />2. All other terms and conditions of the Agreement shall remain in effect and <br />unchanged. <br />// <br />// <br />// <br />// <br />// <br />
