ADOPT AN ORDINANCE AMENDING CHAPTER 18 ARTICLE III OF <br />THE SANTA ANA MUNICIPAL CODE <br /> <br />Legal notice published in the Orange County Reporter on October 6, 2006 <br /> <br />Staff presentation by Police Chief Paul Walters; highlights of this <br />presentation are as follows: <br />. On June 30, 2004, California enacted the Cigarette and Tobacco <br />Products Licensing Act <br />. All Tobacco Retailers must be licensed <br />. Conviction or non-compliance with the Stop Tobacco Access to Kids <br />Enforcement (STAKE) Act can result in suspension or revocation of <br />retail license <br />. STAKE Act strengthens enforcement activities and establishes <br />compliance strategy for state laws <br />. Santa Ana wishes to protect the health of youth from risks associated <br />with smoking by reducing youth access to tobacco products <br />. 331 State-authorized tobacco retailers conduct business in the City <br />. 35% of these tobacco retailers are located within 1,000 feet of a school <br />. Since 1996, the average sales rate of tobacco to minors in the City has <br />been 35.7% <br />. This is 13% higher than the statewide average sales rate <br />. Santa Ana is a young city with approximately 34.2% of residents under <br />the age of 18 years old <br />.
