<br />Conditional Use Permit No. 2006-14 <br />September 25, 2006 <br />Page 1 of 2 <br /> <br />Findings of Fact <br /> <br />A. <br /> <br />Will the proposed <br />contribute to the <br />community? <br /> <br />use provide a <br />general well <br /> <br />service or <br />being of <br /> <br />facility which will <br />the neighborhood or <br /> <br />The proposed new building will contribute to the general well <br />being of the area by providing new pedestrian friendly <br />commercial space along the predominantly commercial Fourth <br />Street corridor on a lot that has been vacant for a long <br />period of time. Further, the proposed residential land use in <br />the upper floors of the proposed building will only enhance the <br />vibrancy of the Downtown by bringing additional consumers and <br />entrepreneurs directly to the area. <br /> <br />B. will the proposed use under the circumstances of the particular case <br />be detrimental to the health, safety or general welfare of persons <br />residing or working in the vicinity? <br /> <br />The proposed residential land use in the upper floors of the <br />proposed building will not be detrimental to the health, safety <br />or general welfare of persons residing or working in the <br />vicini ty. The parking garage is secured via remote control <br />access only to allow for secure use of the parking area for <br />residents. Additionally, the alley will be well-lit to as to <br />offer increased safety and more visibility to drivers. The <br />parking area will also be enhanced through a mirror to allow <br />drivers backing into the alley to see oncoming traffic. <br />Oncoming traffic will be notified when a vehicle is backing out <br />of the parking area through the use of a flasher light <br />triggered by the garage door opening. The front courtyard area <br />of the building will be enclosed with a safety gate to prevent <br />vandalism and graffiti. <br /> <br />C. Will the proposed use adversely affect the present economic <br />stability or future economic development of properties surrounding <br />the area? <br /> <br />The new building, in conjunction with high quality landscape, <br />hardscape and architectural style and materials, will be <br />visually pleasing and offer a highly improved appearance from <br />the vacant lot.
