<br />KO - 10/10/06 <br /> <br />RESOLUTION <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING SITE PLAN REVIEW NO. 2006- <br />07 AS CONDITIONED AND CONDITIONAL USE PERMIT <br />NO. 2006-14 AS CONDITIONED FOR LIVE-WORK <br />COMMUNITY FOR THE PROPERTY LOCATED AT 320 <br />WEST FOURTH STREET WHICH IS WITHIN SPECIFIC <br />DEVELOPMENT NO. 80 (SD-80) <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. Applicant is requesting approval Mitigated Negative Declaration and <br />Mitigation Monitoring Program, Environmental Review No. 2004-234, <br />Amendment Application No. 2006-04 rezoning the property from Central <br />Business - Artist's Village (C3-A) to Specific Development No. 80 (SD- <br />80), Conditional Use Permit No. 2006-13 to allow a live-work community, <br />and approval of Site Plan Review No. 2006-07 to allow the construction of <br />a new 16,000 square foot mixed-use building with 1,189 square feet of <br />retail on the first floor, 3,544 of basement that includes parking and <br />storage, as well as five live-work community units occupying the remaining <br />upper floors for the property located at 320 West Fourth Street. <br /> <br />B. Mitigated Negative Declaration and Mitigation Monitoring Program, <br />Environmental Review No. 2004-234, Amendment Application No. 2006- <br />04, Conditional Use Permit No. 2006-13, and Site Plan Review No. 2006- <br />07 came before the City Council of the City of Santa Ana for a public <br />hearing October 23, 2006, and at that time considered all testimony, <br />written and oral. <br /> <br />C. On September 25, 2006, the Planning Commission held a duly noticed <br />public hearing and unanimously voted to recommend that the City Council: <br /> <br />1. Approve and adopt the Mitigated Negative Declaration and <br />Mitigation Monitoring Program, Environmental Review No. 2004- <br />234. <br /> <br />2. Adopt an ordinance approving Amendment Application No. 2006- <br />04. <br /> <br />3. Adopt a resolution approving Site Plan Review No. 2006-07 as <br /> <br />Resolution No. 2006- <br />Page 1 of 11 <br /> <br />75A-85 <br />
