INSURANCE N01 ON FV WORK MAY N2 PROCEE � ) CLERK OF COUNCIL DATE: 11 -21 -Of - 0 '. -21-Obo: FWACz-)(T.%re:i) THIRD AMENDMENT TO AGREEMENT A-2006-254 THIS THIRD AMENDMENT TO AGREEMENT is entered into on September 5, 2006, by and between Dougherty + Dougherty Architects, LLP, a California corporation ("Program Manager") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). RECITALS A. The parties entered into Consultant Agreement A-2004-020, dated February 2, 2004, (hereinafter "said Agreement') by which Program Manager has provided architectural design services for various parks and City facility improvements, including upgrading the City Emergency Operations Center and installation of security bollards at the Santa Ana Depot. B. In accordance with the terms and conditions of said Agreement, the parties wish to increase Compensation to provide for increased materials and specialized contractor labor costs incurred in completing the Emergency Operations Center, which in turn increases the Program Management fee for the project. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Third Amendment to Agreement, the parties agree as follows: Section 2, COMPENSATION, shall be amended to increase the project budget for Project 3 as follows: The Program Management fee is increased from $4500 to $11,313.74. The architectural fee is increased from $18,000 to $45,254.97. The construction budget is increased from $150,000 to $377,124.78. The total project increase is $261,193.49. The total sum to be expended under said Agreement shall not exceed $1,271,090.00 during the term of this Agreement. 2. Except as herein amended, all terms and conditions of said Agreement shall remain in full force and effect. H H
