Part Four — Performance Period Activities, Continued <br />Accessibility of The federal Department of Homeland Security, the DHS Office of Inspector <br />Records General, the Comptroller General of the United States, OES, and any of their <br />authorized representatives, shall have the right of access to any books, <br />documents, papers, or other records which are pertinent to the grant, in order <br />to make audits, examinations, excerpts and transcripts. The right of access is <br />not limited to the required retention period but shall last as long as the records <br />are retained. Refer to 44 CFR 13.42 for more information about accessibility <br />of records. <br />Suspension Or Should a jurisdiction materially fail to comply with any term of an award, <br />Termination whether stated in a Federal statute or regulation, an assurance, in a state plan <br />or application, a notice of award, or elsewhere, OES may take one or more of <br />the following actions: <br />• Temporarily withhold cash payments pending correction of the <br />deficiency by the jurisdiction; <br />• Disallow all or part of the cost of the activity or action not in <br />compliance; <br />• Wholly or partly suspend or terminate the current award for the <br />jurisdiction's program; <br />• Withhold further awards for the program; or <br />• Take other remedies that may be legally available. <br />Before taking action, the state will provide the jurisdiction reasonable notice <br />of intent to impose measures and will make efforts to resolve the problem <br />informally.
