Criminal CDmplaints <br /> <br />In aCCDrdance with the WIA (P.L. 105-200) and the implementing code of Federal <br />sectiDn 667.600.... Federal handling Df criminal complaints and report of fraud, abuse <br />and Dther criminal activity. "All information and complaints involving fraud, abuse or <br />other criminal activity shall be repDrted directly and immediately tD the City of Santa <br />Ana and the Secretary Df LabDr." <br /> <br />II. General Procedures for Handling Non-Criminal Violations of the Act <br /> <br />The fDllDwing prDcedure is prDmulgated tD meet the requirements Df Title 20, of the CDde Df <br />Federal RegulatiDns, SectiDn 667.600 thrDugh 667.640 of the WIA regulations, and Section <br />181(c) Dfthe Act (Public Law 105.200: 29 U.S. CDde Sec. 2931 et seq.) at the State and <br />LWIA level fDrthe receipt. invest'lgatiDn, hearing, and resDlution Df complaints by WIA <br />participants, subrecipients, applicants for participat'IDn, or financial assistance, labor unions, <br />community based organizations. or any other persDns. <br /> <br />These prDcedures provide fDr resDlutiDn of nDn-criminal cDmplaints arising from the <br />operatiDn Dfthe Santa Ana LWIA. <br /> <br />A complaint is defined here as a written expressiDn by a p<irty alleging a violation of the <br />Act, regulatiDns promUlgated under the Act, recipient grants, subagreements, or other <br />specific agreements under the Act, including terms and cDnditiDns of employment of such <br />participants in emplDyment training programs. All complaints, amendments and <br />withdrawals shall be in writing. These procedures are intended to resolve matters which <br />concern pDlicies. procedures Dr actiDn(s) arising in connection with WIA programs operated <br />by each LWIA grant recipient and subrecipient under the Act. <br /> <br />These procedures shall nDt be cDnstrued as affecting any other available legal remedy <br />outside Df the WIA cDmplaint process (i.e., disputes regarding terms and conditions of <br />employment of any employee who is not a participant). either separately or simultaneDusly, <br />that a persDn may wish tD pursue in the resolution of a non-WIA complaint.
