N-2006-121 <br />INSURANCE ON FILE <br />WOt?K MAY PROCEED <br />UI iTi'~ ~"dSURANCE EXPIRES <br />/'/•d8 <br />CLERKOF CAUNCIL AGREEMENT FOR REPLACEMENT' OF STREET LIGHT <br />DATE: /-9-07 <br />(o): CPWAXz) CM.Gtrgi~~ <br />THTS AGREEMENT, made and entered into this 4'" day of December, 2006 by and <br />between Moore Electrical Contracting, Inc., a California corporation (hereinafter "Contractor"), <br />and the City of Santa Ana, a charter city and municipal corporation organized and existing under <br />the Constitution and laws of the State of California (hereinafter "City"). <br />RECITALS <br />A. The City desires to retain a Contractor having special skill and knowledge in the ficld of <br />emergency sheet light repair. <br />B. Contractor represents that Contractor is able and willing to provide such services to the <br />City. <br />C. In undertaking the performance of this Agreement, Contractor represents that it is <br />knowledgeable in its field and that any services pcrformed by Contmctor under this <br />Agreement will be perfored m compliance with such standards as may reasonably be <br />expected from a professional electrical contractor in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />SCOPE OF SERVICES <br />Contractor shall famish and install a new light pole ou the existing foundation at the west <br />sick of Main Street, north of Commercial Street, in Santa Ana, California. Said light will <br />conform to the City's street light standards, including 30 feet high with an 8 foot mast arm. <br />2. COMPENSATION <br />a. City agrees to pay, and Conhactor agrees to accept as total payment for the light and <br />installation, the total sum of $6,000.00. The total amount to be expended pursuant to this <br />Agreement shall not exceed $6,600.00, which amount includes a contingency for emergency <br />additions to time Scope of Work. <br />b. Payment by City shall be made within thirty (30) days following receipt of proper <br />invoice evidencing work performed, subject to City accounting procedures. <br />3. TERM <br />This Agreement shall commence on the date first written above and terminate on <br />completion of the street light installation. <br />N1~C Tc~~ KL}-g0 <br />
