<br />LCP/1/29/07 <br /> <br />RESOLUTION <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA LEVYING AN ASSESSMENT FOR THE <br />DOWNTOWN SANTA ANA BUSINESS IMPROVEMENT <br />AREA FOR THE YEAR 2007. <br /> <br />THE CITY COUNCIL FOR THE CITY OF SANTA ANA HEREBY FINDS, <br />DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: <br /> <br />Section 1. The City Council for the City of Santa Ana hereby, finds, determines <br />and declares as follows: <br /> <br />A. On February 6,1984, the City Council, by its Ordinance No. NS-1715, <br />established the Downtown Santa Ana Business Improvement Area. <br /> <br />B. On January 16, 2007, the City Council received and approved the 2006 <br />Annual Report ("the Report") and the 2007 Budget ("the Budget") for the <br />Downtown Santa Ana Business Improvement Area (the "Report") and set <br />its regular meeting of February 5,2007, as the time and place for public <br />hearing on the levy of an assessment on and for the Downtown Santa Ana <br />Business Improvement Area. <br /> <br />C. On February 5,2007, the City Council confirmed the 2006 Annual Report <br />and the 2007 Budget for the Downtown Santa Ana Business Improvement <br />Area. <br /> <br />Section 2. The Report and the Budget are hereby confirmed as written, and <br />adoption of this Resolution shall constitute the levy of an assessment during the year <br />2007 in accordance with Attachment B of the Report, a copy of the Report is attached <br />hereto and incorporated herein by reference. <br /> <br />Section 3. Unless and until changed by resolution of the City Council, the <br />fiscal year of the Downtown Santa Ana Business Improvement Area shall be the <br />calendar year. <br /> <br />Section 4. Notwithstanding anything to the contrary in Ordinance No. NS- <br />1715, from this time forward, the City Council may take action by resolution on any <br />matter pertaining to the Downtown Santa Ana Business Improvement Area as to which <br />such action by resolution is authorized by part 6 (commencing with section 36500) of <br />Division 18 of the Streets and Highways Code of the State of California, known as the <br />"Parking and Business Improvement Area Law of 1989."
