All products used-or developed in the execution of any contr~resulting from this request <br />will remain in the public domain at [he completion of [his project. <br />8. The City has an affirmative action program. The purpose of the affirmative action program is <br />to encourage certified minority business enterprises and women business enterprises. All <br />submitting firms must have established affirmative action programs approvable by the City. <br />The attached "Certification of Non-Discrimination by Contractors" shall be completed by <br />each submitting firm and included in the proposal (Attachment "C"). <br />9. A sample certificate of insurance is enclosed for your reference (Attachment "D"). With <br />respect to performance of work under this Contract, the Team shall maintain and shall require <br />its subcontractors, if any, to maintain insurance as described below: <br />A. Worker's Compensation insurance with statutory limits, any employer's liability <br />insurance with limits not less than $1,000,000 per accident. <br />B. Commercial general liability insurance, or equivalent form, with a combined <br />single limit of not less than $1,000,000 per occurrence. If such insurance <br />contains a general aggregate limit, such limit shall apply separately to each <br />project the Team performs for the City of Santa Ana. Such insurance shall (a) <br />name the City of Santa Ana, its officers, agents, representatives, volunteers and <br />employees as additional insureds; (b) be primary with respect to insurance or <br />self-insurance programs maintained by the City of Santa Ana; and (c) contain <br />standard separation of insureds provisions; and (d) give to the City of Santa Ana <br />prompt and timely notice of claim made or suit instituted arising out of Team's <br />operations hereunder. <br />C. Business automobile liability insurance, or equivalent form, with a combined <br />single limit of not less than $1,000,000 per occurrence. Such insurance shall <br />include coverage for owned, hired and non-owned automobiles. <br />D. Professional liability (errors and omissions) insurance, with a combined single <br />limit of not less than $1,000,000 per occurrence. <br />THE SUBMITTAL REOUHiEMENTS <br />The respondents to this RFQ should submit five numbered sets of written information requested below <br />(with the exception of the Financial Capacity materials, of which one copy should be submitted under <br />separate cover and which will be kept strictly confidential). The Sponsor prefers to receive these materials <br />in vertically bound form, either loose-leaf or spiral, 8 %," x 11 ", with section headings, tabbed and clearly <br />marked by subject titles. <br />The response should state the intended role for each partner or major consultant in [he implementation of <br />the project, as well as dearly delineate the party responsible for overall management. <br />The response will include resumes of the key individuals who will be included in the project and <br />alternative Team members that are candidates for inclusion on the Team. The resumes should describe <br />each individual's/firm's relevant professional qualifications and experience. Candidates should carefully <br />review the qualifications of their Team members to ensure they have not included anyone that has had an <br />adverse history of performance on projects that may cause the panel to reject the proposal because of that <br />deficiency. In addition, candidates are to include 'information pertaining to construction- related litigation <br />within the past 5 years. Inclusion of this information does not mean the candidates will be disqualified. <br />7 of 9 <br />
