Amend an Agreement with EIP Associates <br />and Appropriation Adjustment <br />February 20, 2007 <br />Page 2 <br />Since that time, Shea Homes withdrew a development proposal within the <br />study area. Staff has continued to work with NDC Development, who wishes <br />to pursue a residential mixed-use project in the study area. Along with <br />services of EIP Associates, staff identified a number of potentially <br />significant environmental impacts that could be associated with the <br />implementation of the proposed project. Therefore the preparation of an <br />Environmental Impact Report (EIR) for the project is required, as well as <br />the preparation of zoning level documents that can allow for the proposed <br />development. NDC has agreed to share the cost of these studies and will <br />be funding the majority of the recommended contract. <br />An appropriation adjustment is necessary to recognize the additional <br />amount of consultant fees required for the environmental impact report <br />and to allocate a same amount to the Planning and Building Agency 2006- <br />2007 FY account for contractual services. As a result of the withdrawal <br />of one of the development teams last fiscal year, $29,245 was withheld by <br />the City for Planning fees reimbursed to this applicant. This amount, <br />along with the amount of the requested appropriation adjustment, will <br />cover the net increase to the amended agreement. <br />With the changes and the withdrawal of one of the development teams, a <br />revised scope of work has been outlined. Specifically, the additional <br />monies will fund added environmental analysis including a water supply <br />assessment and health risk assessment. Further, added traffic analysis <br />will be necessary for the study area and region. <br />Staff is recommending a sole source agreement for this project with EIP <br />Associates due to the technical expertise that they have in both <br />environmental analysis for complex projects, as well as for their <br />experience in developing urban design zoning standards. EIP Associates <br />previously prepared the land use study for the project area. This <br />contract will continue to build on that successful effort. Presently, <br />EIP Associates is included in the City's list of qualified environmental <br />consultants and is not under contract with the City or the applicant on <br />any other project. <br />Environmental Impact <br />The awarding of a contract for preparation of an environmental impact <br />report and zoning amendment is statutorily exempt from CEQA. <br />25C-2 <br />
