<br />REQUEST FOR <br />COUNCIL ACTION <br /> <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />CITY COUNCIL MEETING DATE: <br /> <br />MARCH 5, 2007 <br />TITLE: <br /> <br />APPROVED <br /> <br />D As Recommended <br />D As Amended <br />D Ordinance on 1 st Reading <br />D Ordinance on 2nd Reading <br />D Implementing Resolution <br />D Set Public Hearing For <br /> <br />AMENDMENT TO EPIC COMMISSION <br />ORDINANCE TO PERMIT OFFICERS OF <br />PUBLIC AGENCIES <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />CITY MANAGER <br /> <br />RECOMMENDED ACTION <br /> <br />Adopt an ordinance amending Section 2-551 of the Municipal Code related <br />to public officers serving on the EPIC Commission. <br /> <br />DISCUSSION <br />On January 5, 2005, the City Council adopted Ordinance No. NS-2732 <br />establishing the Early Prevention and Intervention Commission (EPIC) as <br />an innovative public/private partnership dedicated offering Santa Ana <br />youth alternatives to the gang involvement. EPIC is composed of 17 <br />members, 6 of which are directly appointed by other public agencies or <br />public officials. Two of those agencies, the Santa Ana Unified School <br />District and Rancho Santiago Community College District have expressed <br />a desire to appoint elected members of their governing boards. Such <br />appointments potentially implicate the common law principle of <br />incompatible office, which, if applied, could cause these appointee's <br />office to be involuntarily vacated. <br /> <br />Under the law of incompatible office, the prohibition on multiple <br />office holding can be abrogated by legislation permitting such <br />practice. The proposed ordinance will amend Section 2-551 of the Santa <br />Ana Municipal Code by expressly permitting the public agency appointees <br />to be either elected or appointed officers of those agency. <br /> <br /> <br />no fiscal impact associated with this action. <br /> <br />1etcher <br />ey <br /> <br />50A-1 <br />
