INSURANCE~J) I UN HL~ WORK MAY tiOI PROCEED CLERK OF COUNCil DATEd/.;l-./o7 /)' (Jets (;1.1 rfi.flllY"~ A-2006-302 FOURTH AMENDMENT TO AGREEMENT THIS FOURTH AMENDMENT TO AGREEMENT is entered into on November 20, 2006, by and between Hygiene Technologies International, Inc., a California corporation ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). RECITALS: A. The parties entered into Agreement No. N-2002-122 dated August 12,2002, (hereinafter "said Agreement") by which Consultant has provided industrial hygiene testing. B. In accordance with the terms and conditions of said Agreement, the parties wish to increase compensation to conclude projects for the City, including indoor air quality improvements, clearance surveys, mold remediation and noise assessment surveys. WHEREFORE, in consideration of the covenants contained in said Agreement, as amended, and subject to all the terms and conditions of said Agreement, except those amended in this Fourth Amendment to Agreement, the parties agree as follows: I. Section 2, COMPENSATION, shall be amended to increase compensation by $100,000.00 for a total of $11 0,000 during the 2006-2007 fiscal year. 3. Except as amended in this Fourth Amendment to Agreement, all terms and conditions of said Agreement, as previously amended, shall remain in full force and effect.
