Maynor, PLC for the legal and protective services <br />representing 25 percent of the total. The total annual fixed fee is <br />calculated to be $96,748.81 and would be paid on a quarterly basis. <br />There are several important benefits to a fixed fee approach over the <br />standard contingency fee formula, including: <br />■ Money owed to MMC/MRC for prior compliance work for reporting periods <br />after January 1, 2000 would be forgiven in exchange for a two-year <br />commitment to the fixed fee program. <br />■ All auditing work would be included in the fixed fee, with the <br />exception of auditing work that is city -specific (e.g., cable <br />television and utility franchise reviews). <br />■ The City would establish an attorney/client relationship for the legal <br />and protective work, ensuring confidentiality and eliminating any <br />potential conflicts of interest. <br />• The new approach provides the City with comparable services for a fixed <br />rate that effectively limits the City's potential liability for future <br />billing for UUT compliance work. <br />No other firms were considered for these services, as MMC/MRC and Donald <br />H. Maynor, PLC are the only parties that offer these services to <br />municipalities. <br />FISCAL IMPACT <br />Funds for the contractual agreements are available in the proposed FY 00- <br />01 Finance Treasury Other Contractual Services account (account no. 11- <br />175-6291). <br />Rod R.
