105 <br />CONSENT CALENDAR <br />PROJECTS - MAINTENANCE, REHABILITATION, IMPROVEMENT, CONSTRUCTION <br />OR CHANGE ORDERS FOR PUBLIC FACILITIES <br />23.A. PROJ NOS. 2199A AND 2998 - MEMORY LANE SLURRY SEAL AND <br />MCFADDEN LIBRARY PARKING LOT IMPROVEMENTS <br />23.E3: <br />Motion: 1. Award in accordance with Requests for Council Action. <br />To Copp Contracting, Inc. in an estimated amount of $86,492.00 <br />2. Receive and file Categorical Exemption for Environmental <br />Review Nos. 00-27 and 00-28. <br />3. Approve funding analysis with a total estimated construction <br />cost of $108,200.00. <br />Barry Jensen and Jerry Blair, representing Hillcrest Contracting, <br />addressed Council with concerns about the proposed award of bid for the <br />Bristol Street Widening Project. Mr. Jensen stated that his client was <br />protesting the award of contract on the basis that the bids from the <br />recommended companies should have been declared non -responsive in <br />that the required DBE information was not submitted at the time of the <br />bids as specified in the Instructions to Bidders and a bid addendum <br />Jim Ross, Executive Director of the Public Works Agency agreed that the <br />instructions did specify that the DBE information must be submitted with <br />the bids, however, he noted that an appendix in the contract specified <br />that the required DBE forms could be submitted within four days after the <br />bids were opened <br />Following the public comments, Council discussion ensued <br />Motion: That the Council reject all bids, and authorize the release of a new <br />Request for Proposal which will clarify inconsistent language, and, <br />instruct staff to return a contract award recommendation to the City <br />Council as soon as possible. <br />MOTION: Moreno SECOND: Bist <br />VOTE: AYES: Bist, Christy, Franklin, Lutz, McGuigan, <br />Moreno, Pulido (7) <br />NOES: None (0) <br />CITY COUNCIL MINUTES <br />104 <br />APRIL 3, 2000 <br />r <br />
